1. Scope and provider
These Terms and Conditions apply to orders placed by consumers through the VANTIQ online shop at vantiq.ch.

Any deviating terms of the customer apply only if we have expressly agreed to them in text form. Individual agreements take precedence over these Terms and Conditions.
2. Product range and product information
We sell in particular tyres, rims, complete wheels, vehicle accessories and complementary products. The product description and the selectable characteristics at the time of ordering are decisive.
Product images are for illustrative purposes. Differences in colour, embossing, tread appearance, packaging or other non-essential characteristics are possible, provided that the ordered specification and fitness for use are not affected.
We sell new, unused goods unless an offer is expressly labelled otherwise. A specific production date or DOT number is owed only if expressly guaranteed in the offer or in an individual agreement. Express age commitments on the product page remain binding.
An unused, properly stored and technically sound tyre is considered new even if it was manufactured up to 36 months before delivery. The production age is determined by the DOT marking on the tyre sidewall. A production age of no more than 36 months does not in itself constitute a defect or grounds for complaint. An expressly guaranteed more recent DOT marking or production age remains binding.
3. Vehicle assignment and selection of suitable products
Tyres and rims must be compatible, among other things, with the vehicle type, dimensions, load index, speed index, rim size, offset, bolt pattern and applicable approval requirements.
Our size, vehicle and type approval search assists selection based on the data available to us. It replaces neither the vehicle registration document nor an individual technical inspection. Before fitting, it must be checked that the delivered goods correspond to the order, the vehicle data and the legal requirements. If you are unsure, please contact us before ordering or fitting.
Goods are not defective if they correspond to the order but do not fit the intended vehicle because the customer provided incorrect or incomplete information. Statutory rights where we have provided incorrect product information remain unaffected.
4. Order and conclusion of contract
The presentation of products in the shop is an invitation to place an order. The customer places the desired items in the cart, enters delivery and payment details, can review and correct the entries before submission, and submits a binding order using the appropriately labelled button that carries an obligation to pay.
After receiving the order, we promptly send an electronic confirmation. The contract is concluded with this order confirmation. If, exceptionally, an ordered item is unavailable or there is a material price or description error that is recognisable to the customer, we will provide prompt notice. Payments already made for unavailable or validly cancelled items will then be refunded in full.
We may refuse orders where there are concrete indications of misuse, fraud, resale contrary to a quantity restriction or insufficient ability to pay.
5. Prices and shipping costs
All prices are stated in Swiss francs (CHF) and include statutory value added tax where due. Any additional shipping costs are shown before the order is submitted.
Unless otherwise stated in the offer or at checkout, the following applies to tyres:
- one tyre: CHF 19.90 shipping;
- two or more tyres: free shipping within Switzerland;
- delivery to the workshop designated by us for fitting: free of charge if this option is offered at checkout.
For other product types, the shipping costs displayed in the cart and at checkout apply. Promotions and vouchers are valid during the stated period and subject to the respective stated conditions.
6. Payment
Only the payment methods displayed at checkout are available. Depending on activation, these may include in particular credit and debit cards, Shop Pay, Apple Pay, Google Pay, TWINT, Klarna, PostFinance or other methods supported by Shopify.
Payment may be processed by Shopify Payments or the selected payment service provider. Additional terms of the payment provider may apply to individual payment methods. Unless otherwise displayed, the total amount is due when the contract is concluded.
Refunds are generally made through the same payment method used for the order. If this is not technically possible, we will agree on a suitable alternative.
7. Delivery
We deliver exclusively to valid delivery addresses in Switzerland. Deliveries abroad are excluded.
The expected delivery time or date is shown with the product or during the ordering process. Delivery information assumes correct and complete delivery details and timely receipt of payment. In the event of unexpected delays, we will inform the customer as soon as possible.
We may send an order in reasonable partial deliveries. The customer will not incur additional shipping costs as a result. If an item is permanently unavailable, we may cancel the relevant item and refund the amount paid for it.
The customer is responsible for ensuring that the shipment can be accepted at the stated address. After prior notice, additional costs actually incurred due to a culpably incorrect address, unjustified refusal of acceptance or uncollected goods may be charged to the customer.
Benefits and risk pass upon delivery of the goods to the customer or to a person designated by the customer and authorised to receive them.
8. Inspection on receipt and transport damage
On receipt, the delivery must be checked for correct items, quantity and visible damage. Where possible, obvious transport damage should be noted immediately with the carrier and reported to us with photographs. A late report does not remove mandatory statutory rights, but may make clarification with the transport service more difficult.
Incorrect deliveries, missing quantities and visible defects must be reported to us as soon as possible at info@vantiq.ch. If a defect or incorrect delivery is suspected, the goods must not be fitted, used or otherwise altered except to the extent required for inspection.
9. No general right of withdrawal or return
Swiss law does not grant a general right of withdrawal or return for ordinary online purchases. VANTIQ does not grant any additional contractual right of withdrawal or return.
Once the contract has been concluded, the order is binding. Goods that are free from defects and have been correctly delivered may be returned only if, in the individual case, we have expressly confirmed this in text form in advance as a goodwill gesture. Such an individual decision does not create any entitlement for other or subsequent orders. Goods sent without prior confirmation may be refused.
Statutory rights in the event of defects, incorrect deliveries or damage for which we are responsible remain unaffected.
10. Warranty for defects
The statutory warranty provisions of the Swiss Code of Obligations apply. The warranty period for new goods is generally two years from delivery.
A defect exists in particular if, at the time of transfer, the goods do not have the warranted characteristics or are not suitable for the use assumed under the contract. Normal wear, improper storage or use, incorrect air pressure, overloading, faulty fitting, external damage, the consequences of accidents and alterations by the customer are not material defects unless caused by us.
For tyres, a production age of up to 36 months upon delivery does not in itself constitute a material defect. Actual material, manufacturing or storage damage, technical impairments and deviation from an expressly guaranteed more recent DOT marking remain grounds for complaint.
Please report any suspected defect immediately, stating the order number, a description and meaningful images. We will then inform you of the next steps. Fitting, removal, repair or transport costs incurred without prior agreement will be covered only where we are legally obliged to do so.
Manufacturer warranties apply in addition to the extent granted by the relevant manufacturer. They do not limit statutory claims against us.
11. Fitting and other services
If fitting or another workshop service is offered during the ordering process, the scope of service, location, appointment and price are determined by the relevant selection or confirmation. A service payable on site is identified as such.
Before work begins, the customer must disclose special vehicle conditions, modifications, spacers, RDKS/TPMS systems, locking wheel nuts or other circumstances relevant to fitting. Additional work that was not recognisable when the contract was concluded will be carried out only after consultation and charged separately.
12. Liability
We have unlimited liability for damage caused intentionally or by gross negligence. For direct and foreseeable damage caused by slight negligence, we are liable to the extent mandatorily required by law. To the extent permitted by law, liability for indirect damage, consequential damage and loss of profit is excluded.
Limitations of liability do not apply in the event of injury to life, body or health, fraudulently concealed defects, expressly assumed guarantees or mandatory product liability law.
For disruptions outside our sphere of influence, in particular failures of telecommunications, Shopify, payment or logistics services, we are liable only to the extent that we are at fault ourselves.
13. Data protection
We process personal data in accordance with our privacy policy. For order fulfilment, required data may be transmitted in particular to Shopify, payment service providers, shipping companies, suppliers and fitting partners.
14. Force majeure
If a party is temporarily unable to fulfil its obligations due to an event outside its reasonable sphere of influence, affected deadlines will be extended appropriately. Such events may include in particular natural events, epidemics, measures by authorities, war, strikes, energy or transport outages and material disruptions at upstream suppliers.
If the impediment lasts longer than 30 days and continuation of the contract cannot reasonably be required, either party may terminate the part of the contract that has not yet been performed. Payments made for services not provided will be refunded.
15. Amendments to these Terms and Conditions
The version of the Terms and Conditions available when the order was submitted applies to that order. Amendments do not have retroactive effect on contracts already concluded.
16. Applicable law and jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory statutory places of jurisdiction apply to claims brought by consumers. In all other respects, the courts at the registered office of Uniq Cars GmbH have jurisdiction.
